This panel will discuss: (A) the U.S. Bank Regulators’ QFC Stay Rules, and use of the various QFC compliance provision documents, including using the ISDA 2018 US Resolution Stay Protocol, the ISDA Bilateral Amendment, and the IECA’s Customized Version of the ISDA Bilateral Amendment to amend existing QFCs with GSIBs, plus (B) QFC Stay Rule compliance provisions for new QFCs with GSIBs; (B) Federal Reserve Board’s proposed changes to Regulation EE regarding “netting eligibility for financial institutions” and potential effects on ensuring enforceability in bankruptcy of the IECA Master Netting Agreement; and (C) the Bank Regulators’ SA-CCR Rules – and the potential impacts on energy commodity trades, especially power, with bank counterparties.
